Welcome to Cloche ("the Service"), a gardening companion app operated by Cloche ("we," "us," or "our") at clochegarden.com. By creating an account or using the Service, you agree to these Terms of Service. Please read them carefully.
By accessing or using Cloche, you confirm that you are at least 13 years old and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Cloche provides a digital gardening platform including plant tracking, AI-powered gardening advice, weather integration, personalized planting schedules, and related features. The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of it at any time.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at hello@clochegarden.com if you suspect unauthorized use.
Cloche offers a free trial period followed by paid subscription plans. Payments are processed securely via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. Subscriptions renew automatically unless cancelled before the renewal date.

You retain ownership of content you submit (e.g., garden photos, journal entries, notes). By uploading content, you grant us a limited, non-exclusive, royalty-free license to store, process, and display it solely to provide the Service to you. We do not sell your content to third parties.
Cloche uses AI to provide gardening advice, plant identification, and care recommendations. All gardening advice provided by Cloche is informational only and not guaranteed. Results may vary based on local conditions, user actions, and environmental factors.
AI outputs are not a substitute for professional horticultural advice. We are not liable for crop failures, plant losses, or other outcomes resulting from following AI-generated recommendations. For serious plant health concerns, consult your local cooperative extension office or a certified horticulturist.
Cloche participates in the Amazon Associates Program and may earn a commission from qualifying purchases made through affiliate links displayed in the app. Affiliate links are identified within the product recommendation feature. This does not increase the price you pay. Inclusion of a product recommendation does not constitute an endorsement of that specific product for your garden conditions.
The Cloche name, bell dome logo, app design, and all content we create (plant database, zone data, care algorithms) are our intellectual property. You may not reproduce, distribute, or create derivative works from our proprietary content without written permission.
You may delete your account at any time from your account settings. We may suspend or terminate accounts that violate these Terms. Upon termination, your right to use the Service ceases and your data will be deleted per our Privacy Policy.
The Service is provided without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, or consequential damages (including crop losses, data loss, or lost profits) arising from your use of the Service, even if we were advised of the possibility of such damages.
Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
We may update these Terms from time to time. We will notify you of material changes via email or in-app notice at least 7 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
